Zoning Hearing Board
The Brentwood Zoning Hearing Board has jurisdiction over several matters related to the application of the Borough Zoning Code. Five Borough residents serve as volunteers on this body, which typically meets on the fourth Wednesday of each month.
The most common duty of the Zoning Hearing Board is to rule on requests for a variance from Borough Zoning Code requirements. Variances are only granted when an applicant demonstrates that zoning stipulations impose an unnecessary hardship. The committee also makes determinations regarding structural constructions and parcels uses that are only permitted as a special exemption under the Borough Zoning Code.
Less frequently, the Zoning Hearing Board functions as an appeals panel. The body has exclusive authority over challenges to the validity of any clause of the Borough Zoning Code. When a developer contests any zoning determination of the Building Code Official, the Zoning Hearing Board may make a final judgment on the validity of the decision.
